High Court Judge, Justice Margaret Oumo Oguli is today slated to officially start hearing both sides in a case in which Lubaga South MP Paul Kato Lubwama is accused of using fake academic papers to earn himself a seat in the 10th Parliament.
Lubwama was dragged to court by Buwembo Habib an activist who argues that the comedian miserably failed O’level and so could not have obtained a certificate after earning himself a result 7.
With result 7, one is not eligible to receive a certificate from UNEB. This same certificate is the requisite for one to join A’level or a tertiary institution.
But without the certificate, as confirmed by UNEB, Kato Lubwama claims to have obtained a Diploma in MDD from Uganda’s most prestigious university, Makerere.
On Friday, Justice Oguli squashed application by the plaintiff’s lawyers to drag Makerere University in the suit as a third respondent since they are hiding some documents that are said to be relevant to this suit.
The application was filed by Isaac Kimaze Ssemakadde, Buwembo’s lead lawyer, but in her ruling, Justice Oguli said court was not convinced that adding Makerere would add anything to the case. “We can reach a logical conclusion of the case without Makerere” she added.
Today, the plaintiff’s lawyers are expected to face the first difficulty of convincing Justice Oguli to accept their case as out of time after High court concluded the determination of other Parliamentary election petitions.
Kato Lubwama has since the beginning argued that the case will end before it starts, claiming it was filed out of time and should be dismissed as per the parliament’s act.
Buwembo’s lawyers are today expected to file an application for extension of time before Lubwama’s legal team led by Asuman Basalirwa presents its preliminary objection.
