High court Justice Margaret Oumo Oguli is today expected to deliver a ruling in a case where the Lubaga south mp, Paul Kato Lubwama’s election to the 9th parliament is being questioned by a voter over academic qualifications.
On Monday, Justice Oguli heard arguments from both sides and decided she would deliver her ruling this morning at 10:00am.
According to Habib Buwembo, the petitioner, Kato failed O’level and as such, did not obtain a certificate, which is requisite to obtain any higher qualification.
According to UNEB, Kato Lubwama scored a result 7 which is a total failure and requires one to repeat, but there is no history of the legislator repeating.
He however went ahead and obtained a diploma in music dance and drama from Makerere University using the fake result. Lawyers representing Kato Lubwama, led by Asuman Basalirwa asked for dismissal of the case claiming it was filed out of the stipulated time for parliamentary electoral petitions which is 30 days.
Buwembo is seeking court to allow him an extension of time to file his petition after failing to honor the 30 days rule.
