The military Court Martial has Tuesday released on bail three people, James Magada, (Crime Intelligence), Faisal Katende (Flying Squad) and Amon Kwarisima on bail.

The trio was released on 10 million non cash bail each, while their three sureties were bonded at 5 million non cash bond.

These are part of a group of nine people who are accused of kidnapping before repatriating Lt. Joel Mutabazi, a former bodyguard to Rwandan president Paul Kagame to Rwanda in 2013.

The others are; former commander police Special Operations Unit, Senior Superintendent of Police Nixon Agasiirwe, Senior Commissioner of Police Joel Aguma(Commandant of Professional Standard Unit) Sgt Abel Tumukunde ( Flying Squad) Rene Rutangira(Rwandese) and Bahati Mugenga(Congolese).

It is alleged that while at Kammengo, in Mpigi district along Masaka road, on 25th October 2013, the accused persons using a pistol and grenades abducted Lt. Joel Mutabaazi and Jackson Kalemera whom they took back to Rwanda without their knowledge contrary to the Penal Code Act.
Prosecution further states that the accused are people subject to military law for using weapons (pistol and grenade) which are ordinarily a monopoly of the army according to the UPDF Act 2005.

In his ruling this morning, Court Martial chairman Lt.Gen. Guti ordered all the accused who were released on Bail to deposit their passports with the court and not to move outside Kampala and Wakiso without court’s permission.

They will also report to the court’s registrar twice every month, warning them of re-arrest in case of failure to adhere to the above conditions.
However, Lt. Gen. Guti denied bail to Joel Aguma, the former commander of the Professional Standards Unit, while Nixon Agasiirwe’s bail is still pending determination by the same army court.

The duo sought redress from the High Court in Kampala. Court was adjourned until 5th January 2018.
