A request by the Attorney General’s office to have the FDC defiance campaign banned has suffered a setback after the office of the Attorney General withdrew it.
The constitutional court under the chairmanship of deputy chief Justice Steven Kavuma was sitting this afternoon at the request of the attorney general to completely ban the FDC defiance campaign, which had been halted for 2 months.
This now means the campaign which includes weekly prayers and many other sub campaigns continue until the Constitutional court decides on its legality.
Today, the Attorney General wrote to the Constitutional court withdrawing the interim order against the defiance campaign.
The Attorney General’s letter that was signed by Denis Bireije the acting Director Civil Litigation in the Attorney General’s office said; “We do hereby apply to withdraw the above captioned application under rule 2 (2) of the Court of Appeal Rules with no order as to costs.”
According to FDC lawyer Ladislaus Rwakafuuzi, they were all surprised at reading the AG’s letter.
“He has written to the court withdrawing the order but didn’t give any reason,” says Rwakafuuzi.
Rwakafuzi, explains that the government’s lawyer who missed today’s court sitting was not ready and decided to withdraw the application.
