Former Makindye- Ssabagabo Municipality MP aspirant, Emmanuel Ssempala Kigozi has lost a petition against the incumbent David Sserukenya.

The High Court in Kampala presided over by Justice Winifred Nabisinde dismissed Ssempala’s petition, on grounds that he neither served a copy of his petition to his rival, nor did he file a formal application withdrawing the case. 

The evidence attached on-court record however, shows that Ssempala Kigozi through his lawyers of Alaka and Company Advocates on April  12 filed a notice to withdraw the petition in which he had accused Sserukenya of lack of academic qualifications.

Ssempala Kigozi who contested as an Independent candidate petitioned the High Court in Kampala on March 18th 2021, challenging the decision by the Electoral Commission to declare National Unity Platform's Sserukenya as the winner of the elections.

Sserukenya won with 35,892 votes while Kigozi garnered 19,428 votes.

Kigozi had asked the court to throw Sserukenya out of Parliament, such that he can be the one to represent the Makindye- Ssabagabo Municipality electorates.

He argued that the nomination and subsequent election of Sserukenya were invalid since he did not have a minimum formal education of Advanced Level of education or its equivalent which are the minimum academic qualifications for one to be elected as a Member of Parliament.
