Court Matial to rule on Kitatta Bail Application next month

Abdullah Kitatta, the patron of Boda Boda 2010 will remain in prison until November 6th when the Military Court Martial will sit again to rule on his application for Bail.
The gang leader faces charges of illegal possession of firearms, a monopoly of the UPDF.

He appeared in court today for hearing of his case, where Major David Agaba of the CMI was giving testimony as commanding officer of the operation that led to Kitatta’s arrest.

Through his lawyer Siena Owomugisha, the accused applied for bail on grounds that he needs specialized treatment and that he is a bread winner at home where he has 3 wives and 13 children. Kitatta also points out that Bail is his constitutional right and that being on remand for at least 9 months has triggered of psychological and physical constraint. 

However, prosecution led by Captain Samuel Maserejje opposed his application, arguing that the accused is capable of meddling with evidence, if and once released. 

Capt. Maserejje told court that a sworn affidavit by Major Dennis Katambuka, one of the officers investigating the case indicates that Kitatta is charged with a capital offence and should furnish court with exceptional circumstances under which he should be released. According to Major Katambuka, Kitatta is capable of interfering with investigation, given his level of influence.

It is remembered that during his arrest on January 19th 2018, Kitatta was found in possession of a gold coated pistol, which he confessed to have received from top police administrators. 

Kitatta’s lawyers claim their client has high blood pressure and diabetes which cannot be treated at the Makindye military barracks where he is being held.

Lt. Gen. Andrew Gutti the Court Martial chairman set November 6th 2018 as the day he will deliver judgment on the matter. This was after listening to both prosecution and defence lawyers.
