Trouble has befallen the Member of Parliament Upper Madi County Isaac Etuka Joakino who has been thrown into jail for failure to pay 21 million shillings election petition cost.
Court of Appeal Registrar Agnes Nkonge sent Etuka to Luzira Prison last evening for failing to pay 21 Million Shillings to Arumadri John Drazu, the former MP for Madi who had challenged his 2016 election victory.
Etuka will be held at Luzira for a period not exceeding six months and court also affixed a sum of shillings 3,000 per diem payable weekly.
Trouble for the MP started in 2016 when Forum for Democratic Change Candidate Arumadri went to court challenging the nomination and election of Etuke in Arua High Court. But in his ruling, Justice John Keitirima said that Etuka was legally nominated.
This prompted Arumadri to appeal, challenging the ruling of Justice Keitirima. It was the court of appeal’s panel of three Judges, Remmy Kasule, Richard Buteera and Alfonse Owiny - Dollo that overturned Keitirima’s ruling.
The Justices in their ruling concurred with the petitioner that Etuka was wrongly nominated in the race by the Election Commission and thus ordered for fresh elections which he again won in 2017.
They however also directed Etuka to pay Arumadri costs of the appeal which he never did.
